A crane operator in New York was fined $ 1,600 for operating a luffing tower crane without a valid license.
Operator, Wayne Miller, was working with contractor JF Stearns in April 2016 when, according to the Department of Buildings, he was operating the crane without proper approval and renewal.
At a hearing before the Office of Administrative Procedures and Hearings (OATH), Miller argued that he had not violated the building code and stated that he only needed a Class A operating permit. The judge allowed the subpoena to be changed so that his license was not updated and fined $ 1,600.
Miller appealed the decision, but the decision that he violated both sections of code was upheld along with the $ 1,600 fine.
